By accessing or using Surf Fishing App, you agree to these Terms and to any additional policies or disclosures we present in the product. You may use the service only if you can form a binding agreement with us and if your use is not prohibited by applicable law. If you use the service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

You may need an account to access some features. You agree to provide accurate information, keep your credentials secure, maintain the accuracy of your email and username, and promptly notify us through Support if you believe your account has been compromised. You are responsible for activity that occurs under your account or through identifiers you control, except to the extent caused by our own failure to maintain reasonable service security.

The service may include live map tools, catch or spot posting, weather and bite forecasting, regulations search, fish identification, notifications, subscriptions, support, and related features. Features may change, be limited by geography, depend on third-party data or platform permissions, or become unavailable temporarily because of maintenance, outages, moderation, or safety-related restrictions. We may update, suspend, or discontinue features at any time.

You retain ownership of the text, photos, comments, locations, and other content you submit, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, adapt, publish, display, distribute, and otherwise use that content as needed to operate, improve, secure, promote, and support the service. You represent that you have all rights and permissions necessary to submit the content and that its submission and display will not violate any law, contract, privacy right, or intellectual property right.

You may not use the service to break the law, impersonate others, harass or threaten people, evade moderation, scrape or automate access without permission, interfere with service security, upload malware, spam support or interaction systems, or post content that is infringing, obscene, abusive, fraudulent, or misleading. We may review, remove, limit, or refuse content or accounts, and we may mute, suspend, or ban users when we believe it is necessary for safety, legal compliance, service integrity, or policy enforcement.

Surf Fishing App provides informational tools only. Forecasts, tide timing, regulations summaries, hazard posts, fish identification results, location cams, and user-generated content can be incomplete, delayed, inaccurate, or outdated, and they are not a substitute for official weather, tide, marine, emergency, navigation, fisheries, or legal sources, or for your own judgment in the field. You are responsible for confirming current rules, local conditions, property access, and personal safety before acting on any information you see in the service.

Some features may require a paid subscription or may be subject to usage limits. If you purchase a subscription, you authorize the applicable store or billing provider to charge you on a recurring basis unless you cancel in time under that provider's rules. Pricing, plan structure, trial availability, renewal dates, cancellation flow, and refunds may depend on the Apple App Store or other payment providers, and those providers may impose additional terms that govern your purchase.

The service integrates with third-party platforms and data providers, including authentication, maps, forecasts, fish recognition, notifications, subscription, email, and support infrastructure. We are not responsible for third-party services, data feeds, websites, app stores, policies, or availability, and your use of those services may be governed by their separate terms and privacy notices.

Except for user content and third-party content, the service, software, design, branding, text, graphics, interfaces, and other materials made available by us are protected by intellectual property and other laws. You may not copy, modify, distribute, reverse engineer, or create derivative works from the service except as allowed by law or by our prior written permission.

You may stop using the service at any time and may begin account deletion through the product where available. We may suspend or terminate access, remove content, or preserve records when reasonably necessary to investigate abuse, protect users, comply with law, respond to legal process, resolve disputes, or enforce these Terms. Deleting an account may not immediately remove every backup, moderation, billing, support, or legal record.

To the maximum extent permitted by law, the service and all related content, features, and data are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory. We do not guarantee that the service will be uninterrupted, secure, accurate, reliable, current, or fit for a particular purpose, or that user content or third-party data will be correct or available when you need it.

To the maximum extent permitted by law, Surf Fishing App and its operators, affiliates, service providers, licensors, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, goodwill, fishing opportunities, equipment use, or business interruption arising out of or related to the service. To the maximum extent permitted by law, our total liability for claims arising out of or related to the service will not exceed the greater of the amount you paid us for the service in the 12 months before the claim arose or 50 U.S. dollars.

We may update these Terms from time to time to reflect product, legal, operational, or business changes. If we do, we will post the updated version through the service and update the Last Updated label above, and your continued use after the update becomes effective means you accept the revised Terms to the extent permitted by law.
